Can the U.S. Constitution be Trumped by an International Small Arms Treaty?
With Barrack Obama’s assertion that the Constitution of the United States is a document of negative liberties (i.e., it limits government control of citizens), he made it clear that he’s no fan of the framework of America. As a result, Constitutional supporters are wary of his efforts to subvert the fundamental rights of U.S. citizens. One concern is that President Obama might use a United Nations (UN) international arms trade treaty to circumvent the Second Amendment, which gives people the right to keep and bear arms. A recent rumor is that Secretary of State, Hillary Clinton actually signed a UN international agreement to regulate small arms, thus bypassing the normal legislative process in Congress. Sounds like our guy Obama, doesn’t it? This time you can relax. The National Rifle Association Institute for Legislative Action (NRA-ILA) has the facts about this issue. No small arms treaty has been signed because no such treaty has been negotiated…yet. Unfortunately, the Obama Administration has announced a willingness to engage in United Nations talks to regulate arms sales. This contrasts the Bush Administration policy and contention that national controls were a better way to regulate the sales and distribution of American-produced small arms and ammunition. The reversal in U.S. government stance on a treaty to regulate arms trade could be the catalyst for progress on a UN Arms Trade Treaty (ATT). In fact, there is a good chance that an ATT will be drafted before the end of 2012. So it’s conceivable that President Obama might have the opportunity to sign such an agreement. Luckily, ratification of an international treaty requires approval of two thirds of the U.S. Senate. The President probably can’t garner that level of support from the current congress. But this issue exemplifies the importance of the elections in November 2010. It’s critical to empower conservative leaders who honor the laws and liberties that are the foundation of this great nation. International treaties to enforce gun control on Americans, like all of Obama’s backdoor infringements on freedom, must be neutralized until his defeat in November 2012. Take comfort in the fact that the NRA actively opposes UN arms control initiatives that would affect Second Amendment rights. As a Non-Governmental Organization (NGO) at the United Nations, the NRA has access to UN meetings that are closed to the general public and is able to monitor debate and report back to members.
