Is Florida Malpractice Out Of Control?
When it comes to Florida malpractice it seems according to the current reports, that Florida is one of the states in the US where malpractice is nearly out of control. Remember that the term malpractice is not restricted to the medical field, as there are other cases of malpractice too, like dental malpractice and even legal malpractice. So why are Florida malpractice reports one of the highest in the nation? While the real reason is unknown, experts speculate that it is because of the large majority of senior citizens who live in Florida. Face it, senior citizens spend more time in the hospital than any other age group, and when the percentage of hospital time goes up, so does the number of malpractice reports that can happen. For dental malpractice, seniors have more problems with their teeth than any other age group. And for legal malpractice, there are a lot of wealthy people who retire in Florida, and while it is indeed unfortunate, sometimes seniors can be taken advantage of since many of them have quite significant amounts of disposable income and pensions. As a percentage of the count of malpractice cases being reported, the Florida malpractice cases are actually higher, and are in fact one of the highest in the US. By general definition, malpractice is defined as someone who is supposed to be a professional in their field doing something incorrect or by not considering all the signs, symptoms or evidence thoroughly before taking some type of action, where that action eventually results in damage, physical or emotional harm, and even death to the client or patient. Of course, mistakes can happen, but the reason that we pay the big bucks to these professionals is that within their field of expertise, they are not permitted to make mistakes when the end result of that mistake is harm or damage to the client or patient. As an example, in the state of Florida in particular, there are extreme cases of malpractice in medicine where the doctor amputated the wrong leg of a patient. In the dental world, the dentist extracts the wrong tooth. Or in the legal field, the lawyer misrepresents his client which results in his client unfairly going to jail for an offense he did not commit. It happens all the time, and much more often than what is covered on the news. And based on the information above, Florida is one of the leading states for malpractice cases. Why don't you hear about it more on the news? If the client or patient has a genuinely legitimate case, nearly all professionals will choose to settle out of court. Is it merely that they know they are wrong and don't want to have to put in all that court time? That may be a portion of it but the fundamental reason is that if they settle out of court, they often do so with a gag order so that the client or patient will basically shut up about it, and therefore the professional does not get the mountain of bad publicity that they would if it ended up in court. Does that make it right? Of course not, but residents must be more mindful about the possibility of Florida malpractice happenings. As with any malpractice case, the burden of proof is more on the client or patient than the doctor, dentist or lawyer, but in many situations that is not that difficult to prove. You should keep accurate and detailed records of visits to doctors, dentists and lawyers with dates, names and description of what happened. Those notes will be invaluable to you if you do run into a potential case of malpractice that you should pursue.
